1. Introduction and Club Details
Fitness Space Paddington (hereinafter referred to as “the Club”) is owned and operated by J&H Fitness, 6 Wimbledon Bridge, Wimbledon, London, SW19 7NW
2. Release of Liability & Conditions of Use
By accessing and using the club facilities, members confirm that they do not have any physical, medical, or other condition that may be aggravated or result in loss, damage, injury, or deterioration of health as a consequence of using these facilities. Members accept full responsibility for their participation and acknowledge that they are in good health and suitable physical condition to engage in club activities.
Except where the Club’s negligence results in injury or death, or where there is a breach of statutory duty, members hereby release the Club, its affiliates, associates, and employees from all claims, actions, demands, proceedings, causes of action, and costs of any kind, including those related to loss, damage, or injury to person or property arising from use of the club facilities.
Members understand that participation in club activities carries inherent risks, which may include serious injury, damage to personal property, or death. Members agree to discontinue participation immediately if they feel unsafe or have any concerns regarding their safety.
Members acknowledge that the club may be unsupervised at certain times and accept responsibility for completing an induction to familiarise themselves with the equipment. During unsupervised periods, members are solely responsible for their personal safety. If assistance is required, members must contact a member of staff or use the distress buttons located in the club.
Conditions of Use
The club is remotely monitored at all times.
Equipment is available exclusively to authorised individuals or members.
Active membership is required for access. Sharing access cards or permitting entry to non-members is a breach of these terms and may result in cancellation of membership.
All instructions provided on equipment and during induction must be followed.
Appropriate clothing and footwear must be worn whilst using the club.
Hand towels must be used to clean equipment after use.
Mobile devices must remain on silent whilst in the club.
Tidiness should be maintained and all equipment returned to its designated place after use.
Members must be considerate, courteous, and respectful to other club users at all times.
Any damage or faults must be reported to a member of staff or via the provided contact details.
Members must respect others’ use of the facilities and equipment, sharing the space equitably and not monopolising any equipment or area.
3. Acceptance of Membership
Acceptance of a membership application is at the sole discretion of the Club. The Club reserves the right to verify, or require proof of, all information provided for the purpose of obtaining membership. Any fraudulent or wrongful information supplied may result in cancellation of all membership rights and repayment of any monies due to the Club.
If the membership application is accepted, membership will commence on the date specified in the signed agreement or as otherwise communicated in writing by the Club.
The acceptance of an application for membership constitutes a legally binding agreement between the member and the Club. Members also agree to be bound by the Club Rules. Members will be notified of any updates via email or posted notices within the Club.
4. Limitation of Liability
The member acknowledges that the Club’s obligations and liabilities in respect of the Club are defined in this agreement and/or within the Regulations Applicable to All Users.
Except in cases of gross negligence or wilful misconduct, the Club shall not be liable for any indirect or consequential loss, damage, costs, expenses, theft, or damage to property incurred by members while using the facilities. This exclusion includes, but is not limited to, loss of profit, loss of business, or loss of opportunity. The Club’s liability is limited to direct losses arising from its breach of contract or statutory duty, except where such limitation is not permitted by law. Nothing in this clause shall limit or exclude the Club’s liability for death or personal injury resulting from its negligence, or for any other liability which cannot be excluded or limited by law.
5. Physical Health of Member
Members warrant and represent that they are in good health and are not knowingly incapable of engaging in either active or passive exercise. Members further warrant that such exercise will not be detrimental to their health, safety, comfort, well-being, or physical condition.
Prior to using the Club, members must read a Health Commitment Statement provided by the Club under its obligations as a member of the Fitness Industry Association. Members are strongly encouraged to consult with a healthcare professional before commencing any new exercise programme and to familiarise themselves with the Club’s emergency procedures.
6. Membership Categories and Terms
Memberships are categorised by both membership type and terms.
Membership types and their entitlements are detailed in the Club Rules, available at the front desk or on the Club’s website. The Club Rules outline the specific benefits, facility access, and usage guidelines associated with each membership type.
Membership terms are explained in the Membership Charges and Payment Options document, which may be requested from reception. This document provides information on payment schedules, contract durations, and renewal procedures.
Other categories of membership, such as corporate or student memberships, may be introduced by the Club from time to time. These categories may carry specific entitlements or requirements, which will be communicated at the point of introduction.
7. Membership Charges & Payment Options
All members must pay their membership fees, regardless of whether they use the Club facilities. Payment may be made in monthly instalments or as a single upfront payment.
Club memberships are classified as follows:
Minimum Term Contracts (e.g. 12-month contract)
Rolling Monthly Contracts (e.g. Flexi)
Minimum Term Contracts
Minimum Term Contracts detail the shortest duration a member must remain in the contract, dependent on membership type e.g. 12 months.
People that sign up for Minimum Term Contracts acknowledge that they are committed monthly payments until the minimum term is completed.
To terminate your membership at the end of your contract term, written notification must be provided to the Club at least one calendar month before the minimum contract period expires. Please see terminations section below.
Upon completion of the minimum term the membership will convert to a rolling monthly contract if no termination request has been received
The continuance of monthly payments made to Fitness Space at the end of the minimum period, shall be deemed to constitute renewal of this Membership Agreement for a further fixed period of 1 month at the prevailing rate until written notice is received by Fitness Space at least one calendar month prior to proposed termination date.
Rolling Monthly Contracts
Rolling Monthly Contracts are monthly commitments with a minimum period of one month.
The continuance of monthly payments made to Fitness Space at the end of the minimum period, shall be deemed to constitute renewal of this Membership Agreement for a further fixed period of 1 month at the prevailing rate until written notice is received by Fitness Space at least one calendar month prior to proposed termination date.
8. Cancellation and Early Termination Policy
Cancellation Instructions
To cancel monthly membership, provide written notice to the Club at least one calendar month before the desired end date.
'Flexi' members may cancel by allowing the next full monthly payment to function as notice if notice is received mid-month.
Early Termination Criteria
Illness or Injury: Provide a letter from a registered GP or referring specialist confirming the condition.
Relocation: Submit proof of relocation showing the new address is at least three (3) miles from the Club/Office address.
Bankruptcy: Present official documentation confirming bankruptcy status.
Submission Process
Prepare the required documentation for the chosen termination reason.
Write a formal termination request.
Email the request and supporting documents to wimbledon@fitnessspace.com.
Termination requests are processed from the date written correspondence is received by the Club.
Payment Terms
Rolling Monthly Contracts: If the minimum term has ended and cancellation is requested, one further full calendar monthly payment will be charged from the date written request is received.
If early termination criteria are not met, notice equivalent to one full monthly payment prior to the minimum term is required before membership ends.
Cooling off Period
All memberships are covered under UK consumer protection legislation. Members who join online, by phone, or away from the Club premises are entitled to a 14-day cooling-off period, during which they may cancel their membership for any reason. Cancellation requests must be submitted in writing within the first 14 days of membership, following our standard cancellation process. The Club reserves the right to deduct reasonable charges for any services rendered during the cooling-off period, if the member has requested to begin using the facilities before the cancellation is made.
9. Expulsion of Members/Guests or Termination of Membership by the Club
The Club reserves the right to expel any member or guest, or to terminate the membership of any individual, in the following circumstances:
Immediate Expulsion or Termination for Misconduct
Membership may be terminated without prior notice and with immediate effect if, in the reasonable opinion of the Club, a member’s behaviour is detrimental to the reputation, safety, or interests of the Club or its members. Examples of such conduct include, but are not limited to:
Harassment, intimidation, or bullying of staff, members, or guests.
Engagement in physical or verbal abuse
Vandalism or wilful damage to Club property or facilities
Theft or unauthorised use of Club equipment
Repeated or serious breaches of Club policies or safety guidelines
Conduct that creates an unsafe or hostile environment for others.
Behaviour that brings the Club into disrepute
In this context, ‘injurious to the character, name or interests of the Club’ refers to actions that harm the reputation, integrity, or operations of the Club. ‘Unfit to associate’ refers to behaviour that is disruptive, unsafe, or contrary to the values and standards expected within the Club community.
Termination for Non-Payment
The Club may terminate a membership by providing written notice if any part of the annual or monthly membership fee remains unpaid thirty (30) days after the due date. Any lapses in payment will incur an administration charge.
A member whose membership is terminated by the Club shall immediately forfeit all membership privileges and is not entitled to any refund of membership or product fees.
Appeal Process
Members will receive written notification outlining the specific reasons for expulsion or termination.
Any member who wishes to contest the decision may submit a written appeal within seven (7) days of receiving notice.
Appeals will be reviewed by Club management, and members will be informed in writing of the outcome following consideration of their appeal.
10. Club Facilities and Charges
Certain categories of membership do not include access to all Club services and facilities; any additional services or facilities may be subject to further charges at the discretion of the Club.
Members who fail to attend any pre-booked activity without providing adequate notice may be charged the full standard fee for the missed session.
The Club reserves the right to make reasonable changes to the type or availability of facilities and services provided, including for essential maintenance or improvement works. While every effort will be made to provide reasonable notice of such changes, there may be occasions when facilities are unavailable due to matters beyond the Club’s control. Maintenance disruptions lasting fourteen (14) days or fewer do not automatically entitle members to a refund; any such refund will be at the sole discretion of the Director or Manager.
11. Hours of Opening
Information regarding the Club’s usual hours of operation and facility opening times is available from the Club upon request. These hours may be lengthened or shortened at the absolute discretion of the Club, with or without prior notice. However, the Club shall endeavour to give members at least seven (7) days’ notice of changes to opening hours, except in cases of emergency. On occasions, when necessary, maintenance is needed, the Club, or parts thereof, may be closed. Refunds for closures due to maintenance will be considered if the closure exceeds forty-eight (48) hours, at the discretion of the Director or Manager.
12. Notice and Membership Correspondence
All membership-related correspondence, including cancellation and freeze requests, must be sent to the email address wimbledon@fitnessspace.com. The email will be time-stamped. The Club will endeavour to respond within five (5) working days. If no response is received within five (5) working days, members should contact the Club by telephone or visit in person to ensure the request is processed.
13. Fitness Space Paddington – Club Rules
To ensure a safe, respectful, and enjoyable environment for all members and guests, Fitness Space has established the following Club Rules. These rules form part of your membership agreement and must be always adhered to.
General Conduct
Treat all members, guests, and staff with respect. Abusive, intimidating, or discriminatory behaviour will not be tolerated.
Use appropriate language and avoid disruptive behaviour.
Mobile phones should be used discreetly. No photography or video recording is permitted without prior consent from those involved.
Membership & Access
Membership is personal and non-transferable. Sharing access credentials (e.g., fobs or access cards) is strictly prohibited.
Members must check in at reception or via the designated access system on each visit.
Lost or damaged access devices may incur a replacement fee.
Dress Code
Appropriate gym attire must be worn at all times. This includes clean, non-marking footwear.
Clothing that may cause offense or pose safety risks (e.g., sandals, denim, workwear) is not permitted.
Equipment Use & Hygiene
Wipe down equipment after use with the cleaning products provided.
Return all equipment to its designated storage area after use.
Do not drop or throw weights. Use equipment responsibly and safely.
Report any damaged or faulty equipment to staff immediately.
Personal Safety & Health
Do not attend the gym if you are unwell or have an infectious condition.
Members under 16 are not permitted in the free weights area and must be supervised at all times.
Members are encouraged to complete an induction session before using equipment.
Classes & Bookings
Arrive on time for all classes. Entry may be denied once the warm-up has begun.
Classes must be booked in advance via the Member Area.
Members under the age of 18 are not permitted to attend classes.
Cancellations must be made in accordance with the booking policy. Failure to cancel within the designated time will incur a penalty. Accumulated penalties may lead to temporary restrictions on class booking privileges.
Facilities
Glass containers are not allowed in any workout areas.
Smoking, vaping, and chewing gum are prohibited throughout the premises, including outdoor areas.
Personal belongings should be stored securely. The Club is not responsible for lost or stolen items.
Cooling-Off Period
All memberships are covered under UK consumer protection legislation. Members who join online, by phone, or off-premises are entitled to a 14-day cooling-off period, during which they may cancel their membership for any reason. Cancellation requests must be submitted in writing within the first 14 days of membership, following our standard cancellation process. The Club reserves the right to deduct reasonable charges for any services rendered during the cooling-off period.
